Power of Attorney
If the sale involves the use of a Power of Attorney by your client, you must provide a copy to this office. Any Power of Attorney to be used by the buyer will need to be approved beforehand by the lender and the title insurance company.
For both the buyer and the seller, the Power of Attorney will need to be specific as to the property being sold and must survive the incapacity of the principal. The Power of Attorney should be witnessed and notarized in the manner prescribed by Georgia Law. Should the buyer or seller need a new Power of Attorney, we can prepare one that meets these requirements.
The original Power of Attorney will need to be presented at the closing so that it may be recorded at the courthouse prior to the Warranty Deed.
